Notification
If you are under 16 years old
- You have the right to get an abortion but the abortion provider must tell your parent or legal guardian about your decision to have an abortion at least 24 hours in advance, unless you are married or an emancipated minor. This is called parental notice. Your parents do NOT need to agree with your decision.
- You can ask the abortion provider to notify a grandparent or a licensed mental health professional instead of a parent. Your grandparent or the licensed mental health professional must explain to the provider why they think it is best for you to not involve a parent. This is called waiver of parental notice.
- If you cannot or do not want to involve your parents, or if they will not support your decision, you can ask the court for a judicial bypass. This is a legal process where a judge can give you permission to decide on your own whether to have an abortion.
- In Delaware, the judge has 5 days to decide if you can get an abortion without involving a parent based on your written application. Your application needs to include the following information:
- Your name
- Address where you live
- Mailing address where the court can send your court order
- Phone number the court can call and leave you a message
- Each person who you want notice to be waived for
- Why you are mature and well-informed enough to make the decision to have an abortion without involving your parents
